MY FEISTY 70-year-old neighbor Frances had to call a furnace repairman. After a quick inspection the man put some oil into the motor and handed her a $70 bill for labor. "Labor charges!" Frances exclaimed. "It only took you five minutes."
The repairman explained that his company had a minimum one-hour charge on every house call. "Well, I want my remaining 55 minutes of labor," my neighbor responded and she handed him a rake. He spent the next 55 minutes in her back yard bagging leaves.
Is Miguel Estrada a right-wing nut? That's the essence of the charge made by Democratic Senators filibustering his appeals-court nomination.
To answer that cosmic question, the Senators insist they need access to memos Mr. Estrada wrote while working in the Clinton Justice Department--knowing full well that no President is going to hand over such confidential internal documents.
As White House Counsel Alberto Gonzales has noted, 67 other former Justice officials have been appointed to federal courts and somehow no Senator felt the need to ask for internal memos on them. All living former Solicitors General--including the three Democrats Mr. Estrada served under--support Justices refusal to release the memos.
Republicans also argue that the expected deficits are smaller in proportion to the size of the U.S. economy. Next year's projected $307 billion shortfall would be 2.7 percent of the $10.5 trillion economy — a proportion many economists don't find alarming by itself — and certainly smaller than the 6 percent of the economy the $208 billion deficit of 1983 ate up, the biggest percentage since World War II.
BERLIN, Germany (Reuters) -- A popular German singer who had breast implants paid for by health insurers has sparked a debate about what is wrong with the country's generous but cash-strapped welfare system.
Proposals to trim some services have nevertheless met angry resistance from patients and unions, loath to give up special treatments such as health spa visits, cooking courses, and even insurer-funded taxi fares.
"Last week, in response to Democratic complaints that appeals-court nominee Miguel Estrada has failed to answer questions about his legal views, the White House invited any senator who has doubts about Estrada's views to send him written questions."
The White House asked that questions be sent in by the close of business last Friday, and pledged that Estrada would answer them by Tuesday, March 4. He would answer the questions forthrightly, appropriately, and in a manner consistent with the traditional practice and obligations of judicial nominees, as he has before, wrote White House Counsel Alberto Gonzales in a letter to all 100 senators.
As of [yesterday] afternoon, the administration had not received any questions from any senators, according to administration sources.
Now, it is likely that Republicans will argue that when the White House gave Democrats the chance to ask any question of Estrada - something Democrats had said they dearly wanted - Democrats did not respond.
Rep. Robert Menendez, New Jersey Democrat, and other liberal Hispanics step on dangerous ground by suggesting that conservatives such as judicial nominee Miguel Estrada are not real Hispanics, Anthony Fuentez writes in USA Today.
Such arguments resemble some of U.S. politics worst tendencies - racism for one, said Mr. Fuentez, a graduate student in history at the University of Pennsylvania.
Racism reduces a complex individual personality to a stereotype, as when Harry Belafonte accused Colin Powell of turning his back on the African-American community because he works for the Bush administration. But the argument against Estradas nomination bears an even closer resemblance to another bad tendency in U.S. politics: McCarthyism, Mr. Fuentez said.
That virulent strain of patriotism denounced individuals as un-American simply because they held political views or behaved in ways that some self-appointed judges of patriotism despised. In the fight over the Estrada nomination, some Hispanic liberals have embraced McCarthyisms rhetorical style by essentially calling Estrada un-Hispanic.
"Anyone who wants to know the stakes in the battle over judicial nominee Miguel Estrada can simply observe the ongoing spectacle of the Ninth Circuit Court of Appeals," the Wall Street Journal says.
"Last week the 24-member court refused to overturn the decision last year by one of its three-judge panels declaring the Pledge of Allegiance unconstitutional because it included the words 'under God.'
"We can hope the Supreme Court eventually reverses this judicial invention, but until then schoolkids in the nine states covered by the Circuit will be barred from reciting the Pledge after March 10. This is a splendid message to send just as U.S. troops are about to go to war to defend the principles the Pledge extols," the newspaper said in an editorial.
"The Ninth Circuit is famous for being dominated by the kind of liberal judges much loved by Sens. Pat Leahy, Ted Kennedy and Dick Durbin. These are the Democrats now attempting to alter 200 years of precedent by establishing a new 60-vote Senate standard for confirming judges such as Mr. Estrada because he is allegedly 'out of the mainstream.' "But who are the real judicial extremists? An appellate nominee (Mr. Estrada) who argued cases on behalf of three Democratic solicitor generals under Bill Clinton. Or appellate judges who impose their own legal views on decades of common American practice and legal understanding."
Sure it's all about Estrada not answering questions. That is pure BS. Bottom line is the Democrats will look bad over this and Estrada will be confirmed.
"When a nominee does not answer basic questions, the Senate clearly has a constitutional responsibility to ask for the answers." — Sen. Patrick Leahy, February 26, 2003.
"I believe questions ought to be asked and answered and senators have a right to ask questions and senators have a right to have those questions answered. It is pretty simple." — Sen. Barbara Boxer, February 26, 2003.
"Is it too much to ask of a person who is being offered a lifetime position to simply answer a few questions?" — Sen. Blanche Lincoln, February 13, 2003.
"The Senate has a right to complete and responsive answers to its questions before confirming someone to a life term on such an important court." — Sen. Russell Feingold, February 10, 2003.
"We are straining to find some information on which to base a reasoned judgment about his nomination to the second highest court of the land for a lifetime appointment." — Sen. Richard Durbin, February 26, 2003.
None of these senators — or any other Democrat, for that matter — submitted questions to Estrada, when the White House made the offer last week for senators to submit questions for Estrada.
I don't know why the Dems are filibustering this guy. It's bad precedent and bad politics and he's going to get in anyway. If I was their strategist I'd say well, he's gonna get in anyways. Why not look like hero's, embrace the first Hispanic Juctice and save our bullets for someone else we oppose more strongly and who might be an easier target without running the risk of alienating our hispanic voters.
I can't believe some of them are dumb enough to challenge if he's really a true Hispanic. Amazing. They need some new leadership if you ask me, Tommy Daschle is going the wrong way.
The Democrats have totally lost their marbles on this one. This will hurt them and they'll gain nothing.
It bothers me that Republicans are now saying that they'll do the same in return to a Democratic president. Senators are supposed to be above that kind of pettiness.
We should go back to having the Senate appointed instead of elected. They're just redundant if they don't act like statesmen.

Jurist assails politics in court nominations
2003-03-05 By Gina Holland Associated Press Writer
WASHINGTON -- Supreme Court Justice Antonin Scalia on Tuesday predicted an acrimonious confirmation fight over the court's next vacancy and blamed politics for unfilled openings in lower courts.
Scalia said conservatives and liberals created such logjams by supporting activist judges who do not strictly interpret the Constitution.
The justice, who turns 67 next week, frequently complains that the Constitution is treated by courts as a "living document" that evolves over time. He said that Supreme Court decisions involving abortion, the death penalty and assisted suicide illustrate that philosophy.
Many court districts are now operating with judge shortages, he said, because judge nominations have become "such a politically controversial issue."
"It didn't used to be like that. I hate to think what the next Supreme Court nomination hearings are going to be like because what both sides are looking for are judges who agree with them as to what the new Constitution that they create ought to be," Scalia said during a speech to the American Medical Association. "It's a very sad ending to the game."
Scalia's comments came on the same day that Republicans decided to force a Senate vote on ending a Democratic filibuster against Miguel Estrada, one of President Bush's prized judicial nominees.
Democrats have refused for three weeks to allow a confirmation vote on Estrada, who would become the first Hispanic on the U.S. Court of Appeals for the District of Columbia.
WASHINGTON — A GOP leader is laying into Democrats for not verbally flogging one of their own for comments she made comparing terrorist leader Usama bin Laden to American revolutionaries who wanted freedom from British rule over 200 years ago.
Rep. Marcy Kaptur, D-Ohio, took heat Thursday from House Majority Leader Tom DeLay for remarks she made in an interview that ran in The Toledo Blade over the weekend.
Among the more controversial quotes, Kaptur said: "One could say that Usama bin Laden and these non-nation-state fighters with religious purpose are very similar to those kind of atypical revolutionaries that helped to cast off the British crown."
"This is not a gaffe and should not be treated as such," DeLay, R-Texas, said in a statement Thursday.
A Virginia congressman who said Jewish influence was tilting the nation toward war with Iraq was condemned by Jewish leaders.
Some of these leaders called for Rep. James Morans resignation.
The northern Virginia Democrat issued an apology Monday for insensitive remarks he made at a March 3 forum at a local Episcopal church.
The White House sharply criticized Moran Tuesday. These remarks are shocking. They are wrong and they should not have been said, said press secretary Ari Fleischer. He did not call for Morans resignation.
Talking about the likelihood of war with Iraq, Moran said, If it were not for the strong support of the Jewish community for this war with Iraq, we would not be doing this.
Moran, a seven-term incumbent representing Alexandria, Arlington County and part of Fairfax County, yesterday apologized in a statement, saying, "I made some insensitive remarks that I deeply regret.
I should not have singled out the Jewish community and regret giving any impression that its members are somehow responsible for the course of action being pursued by the Administration, or are somehow behind an impending war, Moran said, elaborating on an apology issued Friday to Jewish news organizations and rabbis that was distributed more widely yesterday.
The left-wing media establishment, which saturated the airwaves and newspaper front pages with a classic feeding frenzy over Sen. Trent Lott’s kind words for 100-year-old Strom Thurmond, is unable to express the slightest concern over a leftist lawmaker’s kind words for a terrorist mass murderer.
One could say that Osama bin Laden and these non-nation-state fighters with religious purpose are very similar to those kind of atypical revolutionaries that helped cast off the British crown,” Rep. Marcy Kaptur, D-Ohio, told the Toledo Blade.
NewsMax.com made repeated requests to top House Democrat leaders to determine if they were prepared to disavow this insult to America’s Founding Fathers. House Minority Leader Nancy Pelosi, D-Calif., and Minority Whip Steny Hoyer, D-Md., refuse to comment.
In Hoyer’s case, the refusal to speak was explicit. Pelosi’s office simply failed repeatedly to respond to our inquiries.
These people will get a pass because they are Liberal Democrats but if a Republican had said this there would be demands for a resignation. The liberals are nothing but a bunch of hypocrits.

I don't think Moran should resign. I didn't think Lott should resign.
Although if I were Lott, I would have seriously thought about walking out on a Republican party that left me to twist in the wind like they did. I put in decades of service and you can't stand with me when the chips are down? --- hell with you, then.
However, "the claim that this is anti-Semitic is just a canard that is designed to undermine the antiwar movement," said Bennis, who is Jewish. "Acknowledging that the Jewish community is one of several influential communities in the U.S. is not anti-Semitic."
I agree with the last sentence. I didn't see anything anti-Semitic in his remarks. I don't think this is any different than my saying that black leadership is on the wrong track. The people who are jumping on him are hypocritical if they demand recognition of groups on the one hand and then slap someone down when he recognizes them in a critical way.
I am probably in the minority but personally I don't care what lettter a guy or gal has before their name. If it's offensive it just is. From this newest idiot making the news or the R House member in MN who made stupid remarks on the floor. Whether it be Patty Murray or the Democratic senator who compared UBL to the founding fathers. Or whether it's Trent Lott. They are all morons and ought to be taken to task in one way or another. Resigning ? I think that's a bit harsh. None of them should have to resgin over some stupid comment, hell there'd be nobody left in Washington. What is appropriate though is that people do take them to task and disagree. Most importantly I think is that the party leadership address these people or at least distance themselves from them.
Some say it's about loyalty, I'd agree but I'd say it's abbout loyalty to principal rather than a party or a person.
tell you what, rob. we can be in the minority together. of course that assumes that i'm paying enough attention to the world around me to deem something offensive :)
Some say it's about loyalty, I'd agree but I'd say it's abbout loyalty to principal rather than a party or a person.
Oh C'mon Wolvie. I am NOT one of the "Hypocrites" that you speak of, and neither are MOST Democrats, and you KNOW IT. That was bullshit, and unlike you.
That comment was directed at the elected officials who had a cow over what Lott said, not any posters here. Sorry I do not think it is bullshit pointing out the double standard the liberals apply to Republicans but let their own party get a pass. Look at some of the others in "your" party. How about old Robert Byrd? Wasn't he in the KKK? Isn't he the one that portrayed a southern general in a recent movie? Yet not one word about that either. The liberals are hypocrits.
That'd been tough for my Dad. He was disabled and we relied on the VA to get medication and oxygen for his emphysema.
If he hadn't have had access to that, who knows where we would have been. But he was a hard-working guy when given the chance. Did stuff I was too soft to do.
But I dont think you have to fret about it JT. Prevailing attitudes are going your way.
When our side carries on about things like this, we get lectured or laughed at. Silly Wellstonian people. Can't set us straight for love or money.
Well, when all the information is out and all the facts are known, then he either will or won't be appointed.
The facts ARE known. He WILL BE confirmed if there is a vote.

A left wing extremist's comment:
I don't apologize for bad thoughts. That second sentence disappointed me deeply. This is proof that there is no god.
Where do you get this stuff Jethro?

No wonder they banned Jethro.
