HAYS, JOHN - St. Paul's first murder victim. John Hays was born about 1802 in Waterford, Ireland, who was serving as a Sergeant in Company E, 5th Regiment at Fort Snelling in 1830. He was reputedly somewhat of a martinet in discipline, precise and exact in his dress, bearing, and actions, yet further described as an honest, courteous, and clever gentleman. He never married, and at the time of his discharge in 1839, he had saved a considerable sum of money.
Just prior to his discharge, he and a close friend and comrade-at-arms, Edward Phelan, staked the first neighboring claims in what is now downtown St. Paul. Phelan, who left the service earlier, looked over both claims until Hays was available, and erected a cabin (with Hays' money) which they would both occupy. Within 5 months of Hays' discharge, it was obvious that the two old friends were truly an "odd couple", disagreeing, often loudly and violently, on virtually everything.

About the middle of September, 1839, Hays mysteriously disappeared. He was missed for several days, and Phelan gave evasive answers to questions by neighbors. When word of the disappearence reached Fort Snelling, where Hays was very popular, Major Taliaferro, the Indian Agent, inquired of his contacts among the Native American community if they had seen Hays. On September 27th, Wabsheedah called at the Fort to report that his sons had found the body of Hays in the river at Carver's Cave. Phelan was arrested for the murder, tried, and served six months in the territorial prison at Prairie du Chien, when a dying Indian confessed to the crime, and Phelan was released.

I've been blowing this off...but now...after I reread it agian...he washed up to Carver's cave...hmmm...maybe the indian threw him off the bluff?

I'm gonna cave in and check out an obvious park today that was mentioned way back in clue 1.  I didn't want to but it's worth a try. Maybe some others are there.  I felt that she was trying to send us on the wrong track but it might have been on target all the time.

I would, but I'm at work... Besides, where I want to look would take too long, I can't find a specific area that looks best. Maybe after another clue.

if it's where I think it is, there will need to be a little more narrowing down before anybody finds it. Even if we are all in that park.  I was at a much easier park last night but it wouldn't last long as it's heavily used and someone could actually stumble across it.  Hopefully this clue will separate the two more.

feels like old time waiting in line...I've been out since noon...now I have to work 4pm to 8pm...then I'll go out again........

so here's the deal...

I been driving all around
I got off the mound.
I then got out my racket
and drove to sackett.
I really felt like a turd.
and went accross town to orchard.
I needed to take a pee
So I left for cherokee.

ok I'm bored...I went to Front and Minnehaha as well.

After all that.....
I really am sad about "Sackett"
just so you know..the park got its name from officer sackett. shot in 1970 by an sniper...
but the park is "ceasing to exist" the ball fields are fading away...and the tennis court has knee high weeds.

We cant make it down to hunt this weekend, but if its still going maybe Mon or tues. Marley thinks its a rec center, specificaly St Clair rec center but also  possibly Irvine, leaning more towards the former after this last clue. I like IM, but not completely sold.
