I'm convinced that gasoline is never going to be cheap again. Too much demand these days. The further China and India advance, the greater the demand on resources.
The job of the Supreme Court is to interpret laws in light of the Constutution, therefore, whether the decision is a "liberal" or a "conservative" one, they are making law or "legislating," every time they make a decision. Utter nonsense. I know you have to say things like that to defend the usurpation of power that is the only possible source of getting laws enacted that you and your ilk support. I gotta think that you really know better because you don't seem thatignorant.
If you think that the Constitution is not a "living document," then the President is not Commander-in-Chief of the Air Force.
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States
no I don't. but if I did or if you and your ilk required it, a legislative fix would suffice.  just because the government violates the constitution doesn't mean that it is a living document. I mean you could say if it were a living document then whatever the government did is automatically ratified as constitutional.
The President isthe Commander-in-Chief of the Air Force because even though the Constitution mentions only the Army and Navy, its intent, that the President be CinC of all US armed forces, is quite clear. If you're of the "it says what it says and that's it" school of Constitutional interpretation, then it would require an amendment to make the President CinC of the Air Force.
The fact that the President as AF CinC is not denied by any rational person is a strong argument in favor of the view that the Constitution is a "living document."

The fact that the President is AF CinC is not denied by any rational person is a strong argument in favor of the view that the Constitution is a "living document." If the Constitution is a living document then the President and Congress can do whatever they want and just say the Constitution has grown.  See how that works? If the Constitution doesn't mean what it meant when it was written then you take issues out of the hands of the people who never intended to relinquish their right to rule themselves on that issue. If the people don't like the current status of the Constitution they can change. There is a mechanism for changing it. That fact leads, logically, to the conclusion that it is not a "living document."
Something tells me that's a complicated adminstrative action. probably not but I am sure the government could make it complicated.
Are you saying that you would want that to happen just to keep to the exact letter of the Constitution? If someone wants to challenge it and that is what is required, then yes. It is a question of governmental power. If you give an inch it takes a mile.
I like the new avatar, THX -- Miss Dolly is highly thought of by friends of mine around Knoxville.
jethro, the reason that the Air Force is not under the Army is that it is clear that the intent of the framers was that the President be CinC of US armed forces. Since the Air Force is a separate organization from the Army and Navy and not mentioned at all in the Constitution, is it your position that the President is not its CinC?
If the Constitution is a living document then the President and Congress can do whatever they want and just say the Constitution has grown. See how that works?
That's not how it works. The Supreme Court is the arbiter of Constitutional interpretation, and tells the legislative and executive branches how far they can go.
have been to TN. a dozen times in my life. I think it is truly a beautiful state, with a LOT of good-ole boys" that have 3 teeth, and half that many brain cells.
We got that here in Minneapolis/St Paul. It is a different culture, but we've got our share of rednecks.
One thing about the South, at least you know who the rednecks are. They're open about it, whereas here they're backstabbing two faced sons of bitches.
It is just a fact. Go there, and take off the beaten path into the woods. See how long you survive, as a YANKEE.
I got that in Springfield MO. I was the "Yankee" when I moved there. I was also from the big northern city so I was automatically a gang member. No shit!
Funniest thing when we moved to MO was, my little sisters teacher sat there and fought with her over my mom having a convertible or not. Her teacher told her she was lying because there was always snow in MN and therefore she couldn't possibly have a convertible.
My sister was upset and told me about it so I went and set her ignorant teacher straight.
Gov. Napolitano, your party does indeed have very many people with values in it. But the Democratic Party is no more representative of the average Democrat's values than the National Council of Churches is of the average Protestant's values. Both are far to the left of their membership.

No. It is my position, without further research, that making the Air Force a separate branch superseded the specific authority government was given by the Constitution. But it doesn't really matter in this instance because it is apparent that the people would ratify amendment. Not so with abortion.
If the Constitution is a living document then the President and Congress can do whatever they want and just say the Constitution has grown. See how that works?

That is what it is supposed to do but that certainly is not what happened with Roe v. Wadeand the case, the name I can't recall immediately, that temporarily banned the death penalty in the '70's. The Constitution was written to accomplish specific goals as were the amendments. When judges apply those provisions to issues that were clearly not addressed by the authors of the Constitution and the amendments they exercise power they were not given and take issues out of the hands of the people without their consent.
I was in TN a number of years ago. I got the usual Yankee ribbing. However, when i told them i had a house, land, and a newer truck, they took an instant dislike to that. Nevermind i was in debt up to my neck at the time. Strange people down there.
Since the Air Force is a separate organization from the Army and Navy and not mentioned at all in the Constitution, is it your position that the President is not its CinC?
No. It is my position, without further research, that making the Air Force a separate branch superseded the specific authority government was given by the Constitution.

You just flunked the "strict constructionist" test bigtime.

Like Al Gore?
It is just a fact. Go there, and take off the beaten path into the woods. See how long you survive, as a YANKEE.
With the attitude that you have, probably not very long. Actually, I have been to Farmville, Virginia and went all over the place with MN liscense plates without any problems. They were inquisitive of what our state was like and told me all the interesting sites to see, but nothing like your stereotype of them.
You want a bad place to go, try L.A. area. I had to go there and drive a car back for work about 10 years ago. Everyone there was asking me if I knew how to get back on the highway from our building. When I asked them what if I made a wrong turn, they told me they probably would never find me or the car again. Remember the riots and the truck driver that got beat for baing white? That was the area I am talking about.
But even there, not all the people were bad. The workers at the plant were extremely nice to me and worried about me getting out safely. How sad that some can ruin it for all.
I lived in Arkansas and Missouri for a while and while there are jerks just like any place, for the most part I found them to be some pretty decent people. They know how hard life can be and are willing to help out their neighbors is what I saw.
By the way, my parents retired to Tennessee and my grandmother, aunt, uncle and 2 cousins still live in Arkansas. Are you telling me they are 3 toothed idiots just like the Clintons? Pretty pathetic to lump entire states into a thing like that. And some wonder why they don't like yankees and won't vote democrat. They just want to be left alone and not called names, but you guys continue with the false prejudices and won't stop.
Same thing for you THX. Were all the people there like Kid Rock's character? I lived in northern Indiana until 10th grade and believe me, there were some there that made those you met look mellow.
Since we're on the kick... I just want to say that the best people I've met were in Manhattan, Chicago and Ely MN. The worst places that I can think of are Billings Montana and Gary Indiana. I'm assuming that you were referring to the Gary area Gramps? Very tough area. I guess Flint Michigan is close but I've never been there.
And I agree that you shouldn't really judge a book by it's cover, but it's hard not to when the cover is all beat up and yelling at you. I may be considered stuck up for saying this, but I think that the term Minnesota Nice was coined for a reason. Of course there's tons of dicks around here like anywhere else, but I believe there are much less than in most areas. And that's taking into consideration that the media fills us full of Truman Show types of Perfect Place To Live bits that are probably done in most major metro areas.

Were all the people there like Kid Rock's character?
No, but a lot, and I mean A LOT of the guys I went to high school with were just like that character. I'm not trying to "dis" people from the South, I just didn't like my experience in Springfield MO.
They were inquisitive of what our state was like and told me all the interesting sites to see, but nothing like your stereotype of them.
That's what I found too in KY & TN. Being the only one without a drawl fingers you out as a non-local right away, and they want to talk to you. I found that pretty much everywhere I went.
I'm assuming that you were referring to the Gary area Gramps?
I was born in Gary, Indiana. Lived just south of there in Dyer/St.John area. We were not in the crap that is Gary, but close enough. When the steel mills closed, there was a lot of people in deep financial trouble. Back then you could drop out of school and get a great paying job in the mills. When they closed, these people were left with house, truck, boat, etc. payments, no job and no high school education. All the jobs seemed to rely on the mills and soon they closed as well. It was a horrible mess for that whole area. I do not know how they are doing now.
I think that the term Minnesota Nice was coined for a reason.
Minnesota is full of nice people. Everywhere you go the people are decent and friendly. That and making more than minimum wage is why I still live here after 20 years. It is getting expensive though with all the taxes. My property taxes have tripled in 11 years. Sure glad I am not living on a retirement income.
Being the only one without a drawl fingers you out
LOL. They told me I talked funny when I moved down south. Guess it is just what you grow up with. We knew a guy that had such a southern twang to his talk you could hardly understand him. The big chew of tobbacco in his mouth didn't help much either. But that guy could sure fix whatever was wrong with your car.
I just don't like it when people stereotype the south like that. It is no different than saying all black are a certain way or all Italians are mobsters. Sure some are a problem, but for the most part, they are normal like you or I and just want to raise their family as best they can. Maybe have a little fun along the way also. One common thing I have noticed about southerners is they don't like it when someone from the north tries to make them look like lesser people. Some of you guys comments would get your arses kicked down there and I guess I can't blame them for that. I wouldn't want those comments made about me.
"Many of us are feeling the same thing - defeat, disappointment, and the sense that our hard and heartfelt work has come to no avail. But we should feel inspired. Here in the great state of MINNESOTA, WE CAN CLAIM A RESOUNDING VICTORY.  John Kerry increased Al Gore’s margin over George W. Bush in this state by over half a million votes! We picked up 13 seats in the Minnesota House of Representatives, changing the balance to 68 Republicans and 66 Democrats, and pending a recount of a fourteenth seat, possibly a 67 to 67 tie! We proved beyond a shadow of red that Minnesota is still a blue state! And more than anyone else, we have ordinary citizen volunteers and activists like you to thank for it. You are the DFL. You succeeded in decisively changing the balance of power in our state!"
The Rat: Who knows, maybe the writer's not whistling through the graveyard.
John Kerry didn't win Minnesota; he won Hennepin, Ramsey and St. Louis counties. That's all it takes to put this state in the blue. It's interesting that Bush won all of the surrounding metro counties and actually the majority of the counties in the state.
I like SUV's, but they're just too overpriced if you ask me.
They'd be even more expensive in a hybrid.
I'm convinced that gasoline is never going to be cheap again. Too much demand these days. The further China and India advance, the greater the demand on resources.
I agree, gas isn't going to get any cheaper.
I take the bus to work, but the wife has to drive & pick up the kids from school everyday, so she drives quite a bit.
I still think gas is cheap considering what a convenience it makes for us as a society.
Kerry & Edwards were all over the south attending Baptist Church, but that's ok.

And your point is what?
I think his point is clear.
If we're now strict Constitutionalists, there will need to be an amendment making the president C in C of the Air Force and the Marines.
That will take several years. Who is in charge in the meantime?
[Edited 2 times. Most recently by on Nov 8, 2004 at 07:48am.]

Thanks. The idea came from Rick. He said he saw or heard her singing "Stairway to Heaven". Sort of creepy. The tagline is also stolen from Rick.
btw: I read Dolly didn't get implants until after she lost a bunch of weight, and therefore a lot of boob.
Oh, and Pieter. I've got a sister that lives near Knoxville in Sweetwater TN. Beautiful country.
Well, I read she didn't get implants until 1986. And did they even have implants way back in the mid 1970's?

A liittle tough on Minnesota rednecks aren't you? Just one of those adjectives would suffice.
Maybe I am a little tough. However, I hate "MN nice". It's a culture all it's own, it's a bunch of malarkey, and I don't like it.
Well, I think it's dying. So, that should make you happy.

This guy's got a point, too:
Liberalism fading in Minnesota
John Kerry didn't win Minnesota; he won Hennepin, Ramsey and St. Louis counties. That's all it takes to put this state in the blue. It's interesting that Bush won all of the surrounding metro counties and actually the majority of the counties in the state.
The tide is turning on liberalism in Minnesota.

By the way, MO. is NOT south of the Mason Dixon Line,
Perhaps you've heard of the "Missouri Compromise"?
I consider MO part of the South.
