Got my car back today after it took a vacation for three months. It came back with some bumps and bruises but still looks good from this angle anyway. My neighbors think I'm nuts for parking it on my front lawn. :chagrin:

I guess this is a good sequeway into my post - I made Bulletin Board yesterday with a post about cars. Here it is:

"Its not limited to men. I love old cars. I credit that to my dad, who used to point out the more noteworthy cars when we would go for a drive. He was partial to Cadillacs and Buicks - and the more chrome, the better. Those cars have personality - some of them even 'smile' - unlike a lot of the tin boxes out there today. It seems like cars from the past were made with higher-quality parts.

"Old cars - really, any nice-looking car - make my heart beat just a little faster, and I feel a little thrill. Or, as my friend 'Green' would say, it gives me sparklies. I think anything that has that effect on a person could be said to be a love affair.

Thanks for the offer to help but my liquor cabinet usually consists of a glass and ice. No reason to store anything since it won't be hanging around that long anyway.

How small do you need those pix to be Bear?

I'm good, actually I think I was just being an idiot and the pictures were fine to begin with. I wasn't seeing clearly last night (had Johnnie goggles on) when I was trying to do it - got it figured out just fine.

Had to wait for a headlight housing that they no longer make because GM lost a contract with the company who makes the plastic for certain car parts.

I just got off the phone with my insurance claim adjuster and he said that I will need to ask the dealer to cover the deductible since they have no real case to prove negligence on their part. If somebody hit it, it would be a different story. Now I need to call Morrie's and see what they will do for me. Hopefully it'll be easy enough for them to add it to their own claim.

Any insights into this on how I should handle it?

I do.

Tell them you took pictures of the car before it was delivered, it's now got hail damage after being in their posession, so you're going to be filing suit for property negligence, and you just wondered who you need to have your attorney contact.

THEN...after they go nuts and freak out, say "Look, I gave you my car, and you gave it back with hail damage. All I want's my car back to normal. What can you do for me?"

They'll fix it then, or at least cut you a check.

I called the dealership, he's the guy to talk to there, apparently there's a bunch of people who have hail damage who were on the lot. According to the guy that I talked to, they don't just fix it b/c it was in their posession, you still have to go through the insurance company.

Hope this helps - my recommendation is to get nasty, since they've got a line of people with the same problem.

Thanks Bear. I talked to a Tyler who's the Service Manager and he says there's no way they can cover all of our deductibles. He said that Tim would say the same thing. I'll probably contact GM at this point since it was their problem that it was outside overnight anyway.

That's a cop out when they say there's no way they can cover all of the deductibles on cars that were damaged IN THEIR LOT! They just don't want to pay for it.

Do they have a sales lot where your car was? You can bet they have hail insurance. And you can be assured they made claims for any damage to THEIR cars.

I'd call the Attorney General's office and ask what legal rights you have. Unless you signed some kind of waiver, I don't think they have a legal leg to stand on if the car was damaged while in their possession. And the fact that this guy admits that "there's a bunch of people who have damage who were on the lot" is pretty much admitting that it hailed while it was there and cars got damaged.

I did the books for a guy who owned a C-Store/Car Wash. Even though there was a sign prominently displayed saying he wasn't responsible for damage, guess what? He was! Unless it was damage to an antenna that hadn't been lowered, because it was specifically stated that all antennas must be lowered before entering the bay. He paid for plenty of damaged bumpers and even damage caused by the driver trying to leave too soon and getting their windshield smashed by the blowers when they were lowered.

I'm sure some people never complained because of the sign, but those who did were covered. BY HIS INSURANCE. He didn't just pay their deductible. Because businesses like that carry insurance just for that purpose.

I just called a friend who owns a station who keeps the cars on a lot. He said Minnesota passed a law recently and send out signs to post in all repair facilities. The signs pretty much say they aren't responsible for any damage, theft or whatever to cars in their possession.

BUT, he also said to make a lot of noise. The squeaky wheel gets the grease and all that. He said to threaten to picket! Ha! I'm in and I have all day! :pbpt:

ETA: I'd still make that call to the Attorney General though. I have a feeling that the law might pertain to cars being serviced and not cars being stored on the lot. They DO have insurace for cars on the lot. Even my friend paused for a minute when I told him your car was on a lot.

I called my insurance company with State Farm. She said that she hasn't seen a dealer ever cover damage. However give it a try. She also said that if you claimed it on your insurance that YES you woud have a SMALL mark on your record and YES it would affect your premium. I told her Id be angry about that because its the dealer who is taking 3 months to repair the car and keeping it outside where as the owner would keep his car in a garage. She did say to tell you to have your insurance company try to recover the $$ from the dealer. :frown:

Overnight Hail Damage Leaves ItÂ’s Mark All Over Fargo-Moorhead

The storm that roared through the Fargo-Moorhead area in the middle of the Thursday night dropped hail as big as softballs. It damaged homes, as you might expect but cars seemed to bear the brunt of it. At Gateway Hyundai-Nissan on South University every car on the lot is damaged, which includes more than 300 cars. The manager says preliminary estimates put the damage at hundreds of thousands of dollars. The story is the same all over the Fargo-Moorhead area; people awoke to broken windshields and sunroofs, and countless dings and dents. That is keeping insurance companies very busy today. Several are bringing in catastrophe teams to handle the large number of claims and of course repair shops are busy as well. Adjusters should be here at Gateway by Friday night, where they will tally up the exact damage. The manager tells us since the damage is so widespread, they'll have a hail sale, rather than try to fix all the cars. Insurance agents tell us the good news is, cause the storm hit in the middle of the night, many people had their cars in the garage.

who's to say it was hail...and not a mechanic that was upset your car was in his parking spot and took out a ball hammer and went nuts???

I want to see the video tape...

wooohoooo stinky....I'm going to sit out in the main street and say look what they did to my car...ya maybe it was an act of god...but it sat there for 6 weeks to fix the headlamp.

sign says:

6 weeks to fix my headlamp. Hail Damage will be longer.

dont think catastophres such as hail warrant a mark on any kind - they can't raise "ones" premium to cover the loss but hey can raise all premiums etc.....

funny thing is the dealership will be doing the work anyway and will be making the jing - tell them to inflate their estimate to cover your deductible cost :smile:

insurance companies like oil companies made record profits this last year - yet we all hear them cry like babies non stop :smile:
