ATLANTA (AP) -- An 88-year-old woman has filed a civil lawsuit claiming that an exterminator pinned her down, shoved a pesticide nozzle into her throat and sprayed it.
Patience Von Suttka, 88, filed the lawsuit Thursday against Orkin Inc. and its former employee, Antonio Battle.
Von Suttka claims the 31-year-old Battle came to her Alpharetta home in March 2004 and became violent after she questioned a higher-than-usual fee for pest control. Battle grabbed Von Suttka’s walker, threw it across the room and jumped on her, she said.
“He shoved my shoulders back and started to spray me and pinned my legs back and leaned against them,” she said.
Von Suttka says she got away after biting Battle three times and called the police, who found Battle in her garage when they arrived.
In two separate cases, Battle also faces criminal charges of rape and reckless conduct for attempting to poison a woman’s drinking water.
A spokeswoman for Orkin said the company had no problems with Battle in the two years he worked for them.
He passed a felony background check and drug test before landing a job there.
“We were shocked,” spokeswoman Martha Craft said. “In fact, he was the pest control technician for some of our company’s top executives.”
Battle was fired hours after he allegedly attacked Von Suttka, she said.
Von Suttka says she still suffers numbness in parts of her face and neck.
A Fulton County grand jury indicted him in November on charges of aggravated assault against Von Suttka and carrying a concealed weapon, said Erik Friedly, a spokesman for the Fulton County district attorney’s office.
Battle also faces charges of trying to poison another Alpharetta woman’s drinking water with pesticides, Friedly said.
He is jailed on charges from Clayton County, where he is accused of kidnapping, aggravated assault and two counts of rape stemming from a Sept. 2004 incident, police said.
Trials in all three cases are pending.

Dang, just read cnn about the summer movies. Here's a quote from George Lucas about the new star wars movie.
"It is a different 'Star Wars,"' Lucas told the AP. "It is a tragedy. It's a real tearjerker. All the women who have seen it, some of the men that have seen it, cried through it."
I dunno, call me crazy, but I just can't see crying at a star wars movie... But it might be fun to go opening night and see all the star wars fans dressed up as jedis and whatnot leaving the theater sobbing...
hahaha... seriously no. I know one crazed star wars fan, and they're so into it, it almost scares me... Shoot the only reason I'd go opening night is they're accomodating on standing in line and buying extra tickets.
I've always liked opening night for any Star Wars movie. You won't find excitement and anticipation in the air for any other type of movie. I foresee the new Indiana Jones flick generating the same type of buzz when it finally comes out too. The only thing I'm doing different this time is getting tickets for the 12:02 showing instead of the 12:01. I actually had elbow room the last time we traded ours in.
I probably said this little Star Wars story before so this is more for me. When Star Wars Episode 1 opened it was huge! Lots of people camped out for weeks and tons of people jammed into the theater for all of the 9 early showings. We were at the 12:01 showing. Packed was an understatement. They were having Star Wars trivia questions and if you answered one right you got to ask the next one. Well we had been drinking a bit more than we should have and were making fun of all the geeks (like we aren't one of them or something)
We knew all the answers of course. Finally my friend Neil shouts out an answer and they then make him stand up and ask a question. He asks if he can ask any question. They all egg him on and say make it a hard one for a change. So he stands up and turns around to a silent but eager crowd of geeks. He then asks: "Does anybody in here know what the first line of a job application is?"
Dead silence
I can't think of a time that I laughed harder in my entire life. I couldn't breathe. I was feeling real faint. All six of the guys I went with were on the floor. We're the only things you could hear in the entire theater. You had to be there. I'm laughing my ass of just thinking about it now.Â
Neil turns back around and says: "I didn't think so"
LOLOL!
Thanks for letting me share that. I needed that for a Monday.

Thanks PM - At first I thought it was because we were all buzzed up but even now I can see the hilarity of it. Unfortunately, something like that can't be reproduced.
I think you're right. We would have probably laughed but kept it quiet as not to offend anyone. This way we didn't give a shit who we offended since that part was already taken care of from Neil. haha
I went with a bunch of buddies to the opening night of the first Mission Impossible movie, and we all had had several adult beverages, CM style. Anyway, we're sitting in the front row, right in the middle. When there's the scene in the restraunt, where he blows up the aquarium to get out, I stood up, turned around, and screamed,
I received a request from the Warner Brothers production crew of the film “Class Action” to shoot in downtown Minneapolis on Wednesday, April 27, 2005, from 9:00 a.m. to 3:00 p.m. They wish to shoot on Marquette Avenue South between 6thStreet S. and 9thStreet S.
<?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:office:office" />
<o:p>
</o:p>
Â
<o:p>
</o:p>
The film, by acclaimed director Niki Caro, deals with the sexual harassment of female employees at Eveleth Taconite Mines during the 1980s and the subsequent law suit that followed.

To make this project happen with as little public disruption as possible here is the plan to handle traffic disruption and public transit re-routes:
<o:p>
</o:p>
Â
<o:p>
</o:p>
There will be intermittent traffic stops at 9thStreet S. and Marquette during the filming sequence of 3 cars driving down Marquette to 6thStreet South (approximately 3 minutes).  These stops will occur between the 11:00 a.m. and 2:00 p.m.   There should be no more than four such stops per hour. There will be intermittent traffic stops of eastbound 8thStreet South at Marquette and westbound 7thStreet South at Marquette for each shoot as well.   Police officers will be stationed at 10th & Marquette, 9th& Marquette, 9thStreet & 2ndAvenue S. Midwest Federal Parking Ramp, 8thand Marquette, IDS Ramp, 7th& Marquette, 7thStreet and 2ns Avenue S. 6th& Marquette.  Warner Brothers will need to hire a minimum of 10 police officers.
<o:p>
</o:p>
Â
<o:p>
</o:p>
Patrons needing access to the Midwest Plaza Parking Ramp during traffic stops will be directed by Police Officers at 9thStreet South & Marquette into the bus lane and to the ramp between 9th& 8thStreets. Traffic will exit this ramp by turning right into the bus lane on Marquette and left onto 9thStreet South.
<o:p>
</o:p>
Â
<o:p>
</o:p>
All meters on Marquette Avenue between 6thStreet S. and 9thStreet South will be hooded andwill need to be removed during the shoot. All other non-metered parking in this area will be posted NO PARKING ON WEDNESDAY, APRIL 27, 2005, BETWEEN 6:00 A.M. AND 3:00 P.M. Period vehicles from the early 1990’s will be parked in these areas during the shoot. We will maintain all pedestrian sidewalk and skyway traffic during the film shoot; however, production assistants will be onsite to prevent gawkers.
<o:p>
</o:p>
Â
<o:p>
</o:p>
Bus traffic on southbound Marquette Avenue would be diverted to 2ndAvenue South at 6thStreet and back to Marquette Avenue at 9thStreet between the hours of 9:00 a.m. and 3:00 p.m.
<o:p>
</o:p>
Â
<o:p>
</o:p>
All affected businesses on Marquette between 6th& 9thStreets have been notified in person and City of Minneapolis Communications will issue a downtown traffic advisory for April 27ththrough the media.
It's kinda weird that WB decided to shoot the downtown scenes during a weekday. most movies are shot on the weekend if it's in the downtown areas. Saves cash and hassles. Plus, then I can go sneak in as an extra. Damn it!
I'd like to be as close to Charlize as I was to Arnold. MMMMMMM HoTTTTTTT!
