FORMER DULUTH LAWMAKER SAYS HE PICKED UP, BUT NEVER STOLE ITEMS

The husband of Minnesota's chief justice was acquitted Tuesday of charges he stole cigars from a St. Paul shop. Thomas Berkelman, 52, of Bloomington, was acquitted of a charge of misdemeanor theft after jurors deliberated for about three hours.

Berkelman, married to Minnesota Supreme Court Chief Justice Kathleen Blatz, had maintained his innocence since he was first accused of pocketing pricey imported cigars during a Feb. 12 visit to Stogies on Grand.

Berkelman is a former state representative from Duluth.

While conceding that he stuffed some cigars in his pockets while browsing, Berkelman said he replaced them and never left the store with cigars for which he had not paid.

"This has been an expensive and painful lesson," Berkelman testified at one point during the trial. The verdict came after a weeklong trial that Berkelman's attorney, William Mauzy, said was the most heavily litigated misdemeanor case he had taken part in during 25 years of criminal defense work.

With a courtroom crowded with high-tech video gear replaying security video, large-scale diagrams of the store's walk-in humidor and enough talk about cigars to satisfy even Sigmund Freud's legendary passion for stogies, the hard-fought case was far from the typical shoplifting trial.

Jurors watched Berkelman grip handfuls of cigars while re-enacting his trip to the store and saw him try to place cigars in various coat pockets and remove them. They sat through exhaustive replays of tape from the store's four security cameras presented in dueling formats, with Mauzy using a DVD player hooked up to a big-screen monitor and Donald Lewis, special assistant St. Paul city attorney, using three small monitors connected to a VCR.

The case took an unusual course on its way to the courtroom as well. An assistant city attorney dismissed the charge in May, citing a lack of evidence, in a move that brought complaints from store owners. City Attorney Clayton Robinson revived the case in July after reviewing evidence at the request of Mayor Norm Coleman and Ramsey County Sheriff Bob Fletcher.

The sheriff launched his own investigation, saying he found no evidence that St. Paul city lawyers had committed misconduct or showed favoritism toward Berkelman in dismissing the charge. The sheriff also found no indication that Blatz "or anyone remotely related to her" had informed the city attorney's office of her relationship to Berkelman.
