My friend (V - who I stayed with when I was there visiting) calling to tell me that on Saturday she her doggie passed away. He had liver cancer. Apparently he declined quickly (about 4 days) and passed fairly peacefully.

I feel so bad for her. That was her golden man (He was a retriever)she loved him like a child. He snuggled with me every night that I stayed there. Such a sweet and gentle doggie.

My irritates: Some guy slamming into my Jeep from behind. Damaging my trailer hitch, frame, back hatch, bumper etc. Being declared a total loss. :frown: Guy having no proof of insurance :angry: :angry: :angry: He said it wasn't his car, so maybe the owner will have insurance. Won't find out till I get the report back from the cops. The guy wanted to leave, but I said no way, not till a cop is here.

Yea I knew it was trouble as soon as I asked if his adress was current. He started acting funny and said thats my license. I asked again he said same thing. I finally said 'Look by law you gotta give me correct info and insurance info" then all of a sudden he wanted to leave and it wasn't his car.....thought I was gonna get in a fight with him for a while there. I had to stand in the street at Plato and 52 and wave people down till someone would call. Meanwhile his GF sitting in the car on the phone talking to someone else.

almost reminds me of the time a guy reversed at a burgerking drive thru, and his trailer hitch punched a hole in the front bumper guard on my malibu. The guy at first wanted to shrug it off as if there was no damage. Then he didn't want to get the insurance involved and offered me an under the table deal. Heh, his girlfriend sat in his vechicle the whole time too.

Blah, I hate having any accidents in a car, they're always a major headache.

That's the kinda person that makes all our premiums higher, ticks me off too, especially since I pay out the nose for coverage.

1. Get a Copy of the Insurance Company Appraisal. When the insurance adjuster finds out that your car is a total loss, they contact a company that performs a market survey of vehicles similar to yours to determine the value of your car. They do this by keeping a database of classified car advertisements, inspecting some vehicles at dealerships, and past evaluations of similar vehicles. Insurance companies often do not include vehicles that are priced higher than what they want to pay in their survey; thus, the average price they generate is often lower than actual market conditions. You have a right to a copy of this report. When the person from the insurance company contacts you (the adjuster) and makes an appraisal of your car, request a copy of it.

   2. Don’t Accept First Offer. Do not accept the insurance company's first offer. If you do some research, you can probably get more.

   3. Do Your Own Research or Contact One of Our Auto Accident Attorneys. Right away, you should do your own market research. The best place to start is by searching the Internet. Thousands of cars are advertised on the Internet at any given time. Go to cars.com. The site has a searchable database of cars by make, model and location within a certain mile radius. Look at the prices of vehicles within 40 miles of your home that are the same make and model as yours (although keep in mind that a year older or newer than yours is also considered "comparable"). Click on the vehicle listing to get more detailed information on these cars. Print out the details for the 10 highest priced cars. Also, look in the auto classified section of your local paper. Make copies of ads for similar vehicles that favorably price your car. If all else fails, call an auto dealer and ask what they believe is the market price of the same year, make and model of your vehicle equipped with similar options. Have them fax or write their answers to you. Average all the figures to get an idea of the true market value of your car.

   4. Find Out the Blue Book Price. "They didn't offer me blue book price, why not?" This is a common question. The answer is that no law requires an insurer to pay for the loss of your car based on the blue book or any other price/value book. It is simply evidence of what a reasonable sum might be and for that reason you should also use it in coming up with a counter proposal to the insurer's offer. To check blue book value, go to carpoint.msn.com and click the pricing link to Kelly Blue Book. Type in your year, make and model, and be sure to check all the options your car had plus mileage. Chances are, the blue book value is higher than what the insurance company offered you. Let the adjuster know your car's blue book value.

   5. Send the Insurance Adjuster Information on Comparables. When the insurance company sends you its market survey results, chances are that none of the "comparables" you found will be on it. You should then mail or fax your research to the insurance adjuster and ask him/her to raise the original offer in light of the higher values your research has uncovered.

   6. Read the Insurance Company Report. Read the insurance company report very carefully. It's supposed to contain comparable values for vehicles available in your area. Many of the vehicles they claim are available in the local market area are neither available nor in the local market. Highlight vehicles that are over 75 miles away. Also highlight ads that are over 3 months old. When you write or speak with the adjuster, tell him/her how many vehicles were either not available or not in the local market. Explain that this makes the report flawed. In addition, certain vehicles on the report may have extra information to document the comparison between it and your car. Verify all this information by calling the dealer or source. If the company claims to have inspected the car, call the dealer to see if they remember anyone inspecting the car. If you have time, go look at the vehicle yourself. It may be in far worse condition than yours.

   7. Get Value for Options. Options make a world of difference in valuing a vehicle. Everyone knows that a car with power windows, power locks, air conditioning, a cassette player, deluxe interiors, etc. is more valuable than a car lacking those options. The problem is that insurance companies do not figure in options at their full value in determining the price of your car. By Minnesota Statute (§72A.201 Subd. 5(9)), it is an unfair settlement practice to "reduce or attempt to reduce for depreciation any settlement or any offer of settlement for items not adversely affected by age, use, or obsolescence." When insurance companies add on only a few hundred dollars at most for all the options you have, they are depreciating them. For example, if your car has a working AM/FM cassette, you should get the full value of that AM/FM cassette player, not something far less. Go to carpoint.msn.com and use Kelly Bluebook to find the retail value of your car as it was actually equipped. Then compare it with the same car lacking those options. The difference between the two is what you should argue the insurance company should add to the value of your car. This can be a significant amount.

   8. Send Pre-Crash Pictures of Your Car. Emphasize the good points of your car. If your car is older, but with low mileage, this should add value. The same is true if the car was in good shape. If you have pictures of the car from before the crash, make sure you send copies to the adjuster.

   9. Be Polite, Yet Firm. The way you present yourself can influence the insurance company's willingness to offer a fair price. Be polite, yet firm. If all goes well, they will probably offer a higher amount. If you don't get a reasonable offer, the law allows you to take them to small claims if the amount in question is under $7,500. Advise the adjuster that you are willing to take that step, if necessary.

  10. Know the Law. Every state has laws governing car accidents and auto insurance. A Minnesota auto accident attorney will help you understand your legal rights and remedies under Minnesota law.

thats usually how it happens! the 4 times out of the year when I didnt have my license I got pulled over for speeding :frown: :eyeroll: :eek: :angry:

did he get any tickets for no proof on insurance? or the rear ending?

what kind of damage did he encure?

when my sister didn't have insurance (years ago) - the person sued her directly for the the 4 grand and won

at least you got his info incase you take him to court

Bummer about the accident, Mikey.

I had one myself today - but not in a car. I tripped over a crack in a sidewalk, crashed myself into a lightpost, knocked the wind out of me and am now home nursing a sore person.

Thankfully, it happened right outside Aspen clinic in Bandana Square where we had just been with my Mom. I was the last to leave so while the kid and my Mom were out having a nice lunch together, I was being xrayed and checked out.

I have prescriptions for pain medication and a muscle relaxant. We'll see how things go before I get those filled. I'm working with ibuprofen and a heating pad for now.

Yea everthing is fine exept our cars. I had no cell w/me. He was cited for 3 violations.

1. No proof Ins

2. Failure to yeild (I think)

3. Failure to use due dillgence (or something like that)

At least I can still drive the car. Hatch back don't open and I cant tow my toys, but I can drive it. What sucks is that I didn't want to pay higher Ins premiums for a vehicle that I would never collect on if damaged, so I only had liability only. Don't cover me, but I figured if it was their fault I'd collect. Well it is their fault, but if they have no insurance I may not collect. And I know very well that even if you sue someone and win, that don't mean you actually get your money. My vehicle wasn't worth that much anyways.

Sorry to hear about your tumble, Terry. Ouch! Just as a precaution, I was prescribed Soma once for a muscle relaxant and it relaxed me alright. I was so out of it I could barely make it to the phone to call my mother to come and help me with my children because I couldn't function at all!

What irritates me?

Where do I begin?

How much time do you have?

LOL!

Contractors who stop showing up.

The appointment clerk who erased my appointment time because they made a wrong assumption.

The restaurant with lukewarm buffet and personnel who don't seem to get my point about why I don't want to eat the food lukewarm (two obvious reasons!). And they still bring the bill.

Stopping at the vet's office a couple of times a week for other things (related to the doggie nursing home here) and STILL forgetting to pick up the blankets I left there when my little doggie had his stroke. They were kind enough to wash them and set them aside, but you think I can remember to get them? Doggie's home and doing well, so that is a good thing!

I'm sure there's more, but I'm guessing you get the idea.

Just as I suspected. I got the cop report today, the woman in the car that wouldn't help or give any info...She's the owner of the vehicle. He said it was her parents car. And guess what?? NO INSURANCE!!! :angry: :angry: :angry: :angry: :angry: :angry: :angry: :angry:

Time for court I suppose. I'l try and call and see if they wanna deal, but I don't think they have any money.

Of course the KBB value of my Jeep is less than $2,000.00. So I suppose I offer to settle for that and they keep the Jeep (not that bad of a deal) or they can give me $1,000 and I keep the Jeep. Does that sound fair? The damages are over $4000.00 wich is more than the vehicle is worth. Either way I'm still screwed because I can't buy another one for that.

I think thats too much to ask if the jeep isn't worth that. I think I'm gonna ask over the blue book cost though. I want the amount I would have to spend to get the same vehicle with the same milage. I figure thats about $2600.

But I may start negotiations at $4000, if I ever find them to negotiate.

What irritates me is, I carry Liability because it's the law. If I hit someone else it will cover their loss, not mine. If I'm hit by someone not following the law, liability should pay for me. Otherwise what the heck am I paying for?

Whats the point of making me pay for no fault insurance then?

The courts won't award you more than the Blue Book. Even if they had insurance their insurance company wouldn't have paid more than Blue Book.

It sucks, because like you said, you can't replace it for what you'd get. But have you checked the Blue Book value? My older ('95) Jeep has a retail value of $6,500, and I think that's what they use.

I know Ot, thats why I think I'll settle for less. Blue book value is only about $2,000 on my jeep. It's only a 1992.

It's just a bad time now. Kinda hard to get a loan for another car when you don't have a job. :frown:

I was hoping the Jeep would last me through till next year, and if I keep it, it probly will, but I can't tow with it now. Even if they straightened it out enough to use the hatchback, once the frame is bent on the towing tongue you lose all strenth in it, and it would be dangerous to try and tow with it.

If I can't tow with it, I don't want it.

You should consider joining a credit union. Often times they're more lenient about giving loans. Or have Penny join and use her income to get a loan on something suitable until you finish school and are employed again.

Mikey - the insurance may not pay more than book value, but being they weren't insured, I would certainly ask for damages - at least to begin with. They damaged it. They don't have insurance. They need to cover damages.

probably.

ours actually went down this year, mostly because the school district portion decreased more than the city and county increased. and our valuation for next year is all of a $700 increase, so we're hoping for more of the same next year.

There was nothing on TV I was interested in last night, so I watched the Inver Grove Heights council meeting. That's always entertaining as they bicker all the time.

The city is trying to push a sewer through an area to benefit a business that wants to move to town and the residents and businesses are going to be assessed even if they have no use for hooking up to it because they already have their own holding tanks, etc. that are perfectly legal in that area. It's a low density area with large acreage and one man stood up and said that his proposed assessment would total over $200,000!

Now imagine if he doesn't pay it within the tax year and spreads it out over the seven years allowed what his taxes will be!

CM, explain to me how that Klein guy gets elected over and over. He's just plain rude and wanted to call the vote before people were done discussing it because he had to go to the bathroom. :eyeroll:

First of all, he knows everyone. And has been around for ever so people know his name. Plus there's a nice sized older population out there who vote for him every time.

We actually do know each other. We've talked a number of times. He's one of the guys who puts on the IGH holiday party at the vets center. He was great to my daughter and I then and when I first met him and his wife when they complimented me on my car since he was a fellow Caddie-man.

Although, I have heard lots and lots of negative things about him and the way he runs things from another council member who's my neighbor. An even better friend of mine. So, I guess I'd side with Chip as far as the politics go but Bill seems OK as a person to me anyway.
